The Immigration Journey of Spouses and Dependent Children of International Students: Eligibility, Application, Challenges and Options

Overview:

Applications for dependents of international students are one of the most complex temporary residence applications in the RISIA scope of practice and ones with the highest refusal rate. In this webinar, we will analyze the different options available in the legislation for dependents of international students, the challenges they face and how to determine which option is best for whom. We will look at who is eligible to apply for a C42 and the options for those who are not.

We will discuss which documents and what information should be included in a template application and how to adapt this template to the personal circumstances of each individual/family. Through several ATIPs and Jurisprudence cases, we will try to determine where Visa Officers focus their attention while reviewing these applications and how this can guide the advice we can provide to our students. We will also discuss the procedure for extending the stay during the main applicant’s studies and after graduation as well as the options for a spouse of a graduate to come to Canada for the first time after the main applicant has graduated. Finally, we will briefly review the options available for applicants after one or many refusals.

Important note: The content of this presentation is an updated version of the workshop of the same name offered at the CBIE 2023 Conference in Vancouver. It includes all the changes made by IRCC since. A French version of the webinar will be offered in person at the Québec Regional Meeting in Montréal in May 2024.

This webinar was approved by CCIC for 4 hours of continued professional development (CPD).

Patrick Bissonnette

International Students Advisor

Université Laval

Patrick Bissonnette is passionate about immigration, international education, and intercultural understanding and has been involved in the field for almost 20 years. Since 2006, Patrick works as an International Student Advisor at Université Laval in Quebec City. He holds, since 2021, the RCIC designation and was previously from 2016 to 2021 a RISIA. He also holds a bachelor’s in social work (Université Laval, 2004). He has also taught in the Programme d’études sur l’immigration et les étudiants internationaux (PEIEI) and is a frequent guest lecturer in the ISIEP. Patrick also seats, since 2019, on CBIE Immigration Advisory Committee. He has a lifelong interest in International Education and is fluent in French, English and Spanish.

Imarú Baquero

Manager, International Student Services

University of Lethbridge

Imarú (Ima) Baquero has worked in international education for over 12 years, in both college and university environments, and currently works as the Manager, International Student Services at the University of Lethbridge. Her responsibilities have included international strategic planning, international student support and advising, education abroad, partnership development, and international student enrolment management. Imarú has been a RISIA since 2017, she is one of the instructors of the CBIE International Students and Immigration Education Program, she is a member of the CBIE Immigration Advisory Committee, and she serves as a co-chair of CBIE’s Student Services Professional Learning Community.
